Terms of Service

1. Agreement

By creating an account or using BrandPilot ("BrandPilot", "we", "us", "our") at https://brandpilots.io, you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

BrandPilot is a social media management platform that helps you create, schedule, and publish content across multiple social media platforms. Features include AI-powered content generation, multi-brand workspaces, scheduling, analytics, and publishing integrations.

We may modify, suspend, or discontinue features at any time. We will give reasonable notice of material changes where possible.

3. Your account

• You must be at least 18 years old to use BrandPilot
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized account access
• You may not share your account or create multiple free accounts

4. Your content

You retain ownership of all content you create, upload, or post through BrandPilot ("Your Content"). By using the service, you grant BrandPilot a limited, non-exclusive licence to store, process, and transmit Your Content solely to provide the service to you.

You represent and warrant that:

• You own or have the right to use all content you upload or publish
• Your content does not infringe any third-party intellectual property rights
• Your content complies with the terms of any connected social media platform

5. Acceptable use

You must not use BrandPilot to:

• Post spam, unsolicited messages, or misleading content
• Violate any applicable law or regulation
• Infringe intellectual property rights
• Publish content that is hateful, threatening, or harassing
• Attempt to gain unauthorized access to any system or account
• Circumvent rate limits, access controls, or platform terms of service
• Use the service to publish content on behalf of others without their consent

We reserve the right to suspend or terminate accounts that violate these rules.

6. Connected social accounts

When you connect a third-party social media account, you authorize BrandPilot to publish content to that account on your behalf. You remain solely responsible for:

• All content published through BrandPilot to your social accounts
• Complying with the terms of service of each connected platform
• Any consequences from content published on those platforms

You can disconnect any social account at any time from Settings → Social Accounts.

7. AI-generated content

BrandPilot uses third-party AI services to generate content suggestions. AI-generated content is provided as a starting point. You are responsible for reviewing, editing, and approving all content before publishing. We do not guarantee the accuracy, originality, or suitability of AI-generated content for your specific purpose.

8. Billing and subscriptions

• Paid plans are billed monthly or annually in advance
• You may cancel at any time; your access continues until the end of the current billing period
• We do not offer refunds for partial months or unused features
• We may change pricing with 30 days' notice; continued use after the change constitutes acceptance
• All prices are in USD unless otherwise stated

9. Intellectual property

The BrandPilot platform, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written permission.

10. Disclaimers

BrandPilot is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will meet your requirements. Social media platforms may change their APIs or policies at any time, which may affect publishing functionality.

11. Limitation of liability

To the maximum extent permitted by law, BrandPilot shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, lost data, or reputational damage. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

You may delete your account at any time. We may terminate or suspend your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by the laws of Barbados. Any disputes shall be resolved in the courts of Barbados.
